Bombay High Court Clarifies Jurisdiction in Commercial Disputes

The Bombay High Court has recently clarified the jurisdiction of commercial courts in India. In a case involving a commercial dispute, the Court held that the Commercial Courts Act, 2015, provides for the constitution of commercial courts at the district judge level and specifies the pecuniary value of commercial disputes that can be heard by these courts. The Court also emphasized the importance of pre-litigation mediation in commercial disputes, as mandated by Section 12A of the Commercial Courts Act, 2015.

This judgment highlights the ongoing efforts to streamline the resolution of commercial disputes in India and the role of commercial courts in ensuring efficient and effective dispute resolution.
